General Terms and Conditions of Sale (GTCS)

1 – PURPOSE
These General Terms and Conditions of Sale (GTCS) define the conditions under which sports supervision services are provided by Thibault VINCENEUX (HORIZON CLIMBING), a state-certified climbing instructor, hereinafter referred to as “the Instructor” or “the Service Provider”.
This agreement is concluded between the Instructor on the one hand and any person making a booking or purchase via the website, hereinafter referred to as “the Client”, on the other hand.
This agreement applies to all individuals listed on the registration form, hereinafter referred to as the Participants. The Participants and the Client are jointly liable.
This agreement constitutes the sole legal framework governing the relationship between the Client and HORIZON CLIMBING.
The commitment takes effect immediately upon:

  • full payment of the activity price,

  • payment of a deposit,

  • or written confirmation of registration for off-website bookings.
     

2 – DURATION
The Client and HORIZON CLIMBING are bound by this contract from the time of registration until the end of the activity.

3 – SERVICES AND CONDITIONS

  • The activities covered by this contract are outdoor and mountain sports, which involve specific and sometimes unpredictable risks. The Client agrees to accept these risks when participating.

  • The activity is supervised by HORIZON CLIMBING or delegated to a certified instructor holding a valid state diploma (climbing and/or mountaineering) and a valid professional instructor card.

  • Participants are part of a supervised group whose size is determined to ensure safety and comply with applicable regulations.

  • Participants are under the Instructor’s responsibility only during the activity. Transportation to and from the activity site is excluded from the Instructor’s responsibility.

  • Participants must comply with the Instructor’s safety instructions at all times. The Instructor may modify the itinerary or objectives depending on terrain, weather, or participant conditions to ensure group safety. Such changes are considered part of the service.
     

4 – REGISTRATION AND BOOKING
Bookings may be made:

  • online via the website

  • by email

  • by phone

A booking becomes final after:

  • confirmation by the Instructor (email or SMS for direct bookings), and/or

  • payment of a deposit or full payment (for website bookings).
     

5 – PRICES
Prices are indicated in euros (€), all taxes included (TTC).
HORIZON CLIMBING can modify prices at any time. The applicable price is the one in effect on the booking date.
Prices include only the services explicitly mentioned. Transportation, accommodation, and meals remain at the Client’s expense unless otherwise stated.

6 – PAYMENT
Payments may be made by:

  • credit/debit card

  • bank transfer (Thibault Vinceneux IBAN : FR76 4061 8805 0300 0407 8947 390)

  • cash

  • Any other methods offered on the website (Paypal)

Depending on the service:

  • deposit upon booking, or

  • full payment before the activity

Late payment may result in cancellation of the booking.

7 – REQUIRED DOCUMENTS

  • Each Participant confirms having provided a medical certificate authorizing participation in the activities or declares on their honor that no medical contraindication exists.

  • Each Participant must provide emergency contact details.

  • The Instructor must be informed of any known medical condition before the activity and reserves the right to refuse participation if safety cannot be ensured.
     

8 – INSURANCE, THEFT AND LOSS OF EQUIPMENT

  • The Instructor holds Professional Civil Liability Insurance.

  • Each Participant must have personal civil liability insurance. Personal accident insurance is strongly recommended.

  • HORIZON CLIMBING cannot be held liable for accidents resulting from failure to follow safety instructions or improper use of equipment.

  • Personal injury or property damage must be covered by the Client’s own insurance.

  • Any accident must be reported immediately to HORIZON CLIMBING.

  • HORIZON CLIMBING is not responsible for theft, loss, or damage of personal belongings.

  • The Instructor may prohibit certain equipment during the activity.

  • Lost or intentionally damaged loaned equipment must be reimbursed by the Client or Participants.
     

9 – CANCELLATION AND REFUNDS
Cancellation by the Client
Unless otherwise agreed:

  • More than 7 days before: full refund

  • Between 3 and 7 days: 50% retained

  • Less than 72 hours: no refund

  • No-show: no refund

Cancellation by the Instructor
In case of:​

  • safety risks

  • insufficient number of participants

  • force majeure

The activity may be postponed or fully refunded without additional compensation.

If the guide determines that weather or other conditions make the activity unsafe, the guide may cancel or postpone the outing. 
In this case, participants will be offered the opportunity to reschedule the activity to a later date.
The final decision regarding weather and safety conditions may be made the day before or on the morning of the activity, depending on conditions.



10 – MODIFICATIONS

  • Changes in Participants’ identities are free of charge and must be notified in writing.

  • Increases in participant numbers will be charged at the original rates.

  • Decreases notified less than 48 hours before the activity give no right to refund. Outstanding amounts remain due. A non-nominative credit note may be issued.

  • If Participants are absent without prior notice, the full price remains due.
     

11 – TERMINATION
HORIZON CLIMBING may immediately suspend or terminate the contract without notice if a Participant’s behavior presents a risk or nuisance.
Consumption of alcohol or drugs before the activity may result in cancellation without refund. The booked services remain payable.

12 – IMAGE RIGHTS AND PRIVACY

  • HORIZON CLIMBING may use photos or videos taken during activities for promotional or communication purposes (website, brochures, social media), unless the Client expressly objects in writing.

  • Image rights will not be transferred to third parties without the Client’s approval.

  • In accordance with French data protection laws, the Client has the right to access, modify, or delete personal data.
     

13 – ACCEPTANCE
Booking a service implies full acceptance of these General Terms and Conditions of Sale.
